법원, 2급 살인 혐의 하태희 씨에 심신상실 판결
정신병원 수용 여부 9월 결정 유족 “사법 시스템 불공정

지난 2024년 버지니아주 레스턴의 골드짐 피트니스 센터에서 한인 남성을 총으로 쏴 숨지게 한 혐의로 재판에 넘겨진 40대 한인 피고인에게 법원이 정신이상을 이유로 형사상 무죄를 선고했다.
페어팩스 카운티 순회법원의 마이클 F. 디바인 판사는 지난 17일 열린 심리에서 2급 살인 및 불법 총기 사용 혐의로 기소된 하태희(45·챈틀리 거주) 씨에게 '정신질환으로 인한 무죄(NGRI)'를 판결했다. 하 씨는 배심원 재판 대신 판사 단독 재판을 선택했다.
이번 판결은 검찰과 변호인 측 정신과 전문의들이 모두 "범행 당시 피고인이 자신의 행동이 위법이라는 사실을 인식할 수 없는 심신상실 상태였다"는 동일한 평가를 내린 점이 결정적이었다. 검찰 관계자는 "전문가들의 의견이 일치해 법적으로 유죄를 입증하기 어려운 한계가 있었다"고 밝혔다.
경찰 조사 결과 피고인과 피해자는 사건 이전 일절 친분이 없었던 것으로 확인됐으며, 범행 동기는 밝혀지지 않았다. 당초 2급 살인 혐의가 인정될 경우 최대 무기징역까지 선고될 수 있었으나, 정신질환이 인정됨에 따라 형사 처벌은 면하게 됐다.
디바인 판사는 하 씨의 신병을 버지니아주 행동보건발달서비스국으로 이관하도록 명령했다. 하 씨는 정밀 정신 감정을 받은 후 오는 9월 17일 열리는 심리에서 정신병원 강제 입원 또는 조건부 석방 여부가 정해질 예정이다.
형사 처벌이 무산되었다는 소식에 피해자 고(故) 최형준 씨의 유족은 깊은 슬픔과 분통을 터뜨렸다.
고인의 형 테리 씨는 현지 언론(NBC4)과의 인터뷰에서 "법이 범죄자에게 너무 관대하며 사법 시스템에 심각한 허점이 있다"며 "이러한 판결은 지역 사회 전체를 위험에 노출시키는 것"이라고 강하게 비판했다.
이번 사건은 2024년 8월 21일 오후 레스턴의 '골드짐'에서 발생했다. 현장 목격자들에 따르면 하 씨는 운동 중이던 최 씨에게 다가가 아무런 말 없이 상체를 향해 6~9발의 총격을 가했으며, 최 씨는 병원으로 이송된 직후 사망했다.
Court Finds Man Not Guilty by Reason of Insanity in 2024 Virginia Gym Shooting
A Virginia judge has found a 45-year-old man Not Guilty by Reason of Insanity (NGRI) in the fatal shooting of a fellow Korean American man inside a Reston fitness center in 2024.
Fairfax County Circuit Court Judge Michael F. Devine delivered the ruling on July 17 during a bench trial, clearing Tae Hee Ha of Chantilly, Virginia, on charges of second-degree murder and the illegal use of a firearm. Ha had opted for a bench trial before a judge rather than a jury trial.
The decision hinged on concurring evaluations from both defense and prosecution mental health experts, who agreed that Ha was in a state of severe mental incapacity at the time of the offense and was unable to understand the wrongfulness of his actions. A spokesperson for the prosecutor's office noted that the unanimous expert testimony posed a legal barrier to securing a criminal conviction.
Police investigations revealed that Ha and the victim, Hyung Joon Choi, had no prior relationship or personal connection before the incident, and a motive was never established. Had Ha been convicted of second-degree murder, he would have faced up to life in prison. Instead, the insanity defense insulates him from standard criminal sentencing.
Judge Devine ordered Ha transferred to the custody of the Virginia Department of Behavioral Health and Developmental Services for a comprehensive psychiatric evaluation. A hearing scheduled for September 17 will determine whether Ha will be involuntarily committed to a psychiatric facility or released on conditional supervision.
Victim’s Family Expresses Grief and Anger
The news that Ha would avoid criminal punishment brought intense grief and frustration to the family of the late Hyung Joon Choi.
Speaking to NBC4, the victim’s brother, Terry Choi, sharply criticized the verdict and the legal framework behind it. "The law is far too lenient on criminals, and there are serious flaws in the justice system," he said, warning that the court's decision "puts the entire community at risk."
The tragedy occurred on the afternoon of August 21, 2024, inside a Gold's Gym in Reston. Witnesses reported that Ha approached Choi, who was working out, and fired six to nine shots into his upper body without speaking a word. Choi was rushed to a hospital, where he succumbed to his injuries shortly after arrival.
