Criminal Division Costs, Fines & Payments If your sole financial resource is a Social Security benefit or Supplemental Security Income, you are NOT required to pay fines and costs until you have another resource or income. As long as your sole income remains unchanged, your account will not go to collections. Any restitution that you have been ordered to pay is NOT included in this exemption of payment and is due as the Court has ordered.

  • Payment Agreement with Guidelines (PDF) Fines, Court Cost and Restitution Upon a conviction of a Felony or Misdemeanor in the Circuit Court, fines and/or Court costs will be assessed against the defendant. All Court costs are assessed in accordance with the Code of Virginia. Fines, Costs, and Restitution are due within 30-days after being sentenced unless otherwise specified in a Court Order. A judgment will be automatically entered unless Fines and Costs are paid in full on the day of sentencing. Please note that additional costs from the trial and/or an appeal may be assessed per §17.1-275.5 and is without a time limit statute. Pursuant to §19.2-305.1(K), payments must be applied to restitution first. Payment Agreement Any individual who is required to pay criminal Fines, Costs and/or Restitution by the Court may establish a payment plan with the Loudoun Circuit Court Clerk’s office. No interest shall accrue on any fines or costs imposed in a criminal case or in a case involving a traffic infraction for a period of 180 days from the date of final judgment or release from confinement. Defendants that have accrued interest because of a Virginia incarceration may complete a Request for Waiver of Interest on Fines and Costs – Form DC-366A and return to the Clerk’s office. A Certification of Incarceration Period – Form DC-366 must be sent to EACH Virginia Correctional Facility you were housed in during the time of interest accrual to receive credit. The Correctional Facility will return the form to the Clerk’s Office. Any individual choosing a payment agreement can do so by clicking the link above to obtain additional information. When mailing the agreement, it must be notarized. The Clerk’s Office has no authority to modify a Judge’s ruling. If you were Court-Ordered to pay a specific monthly amount and can no longer pay that amount, you will need to file a Praecipe and Motion to place the matter on the docket. Community Service Credit Program Effective July 1, 2026, Virginia Courts are required to establish a Community Service Credit Program that allows eligible individuals to earn credit toward Court-Ordered fines and costs through approved community service or qualifying work performed while incarcerated. Eligible individuals may earn credit by:
  • Performing approved community service before or after incarceration; or
  • Receiving credit for qualifying work performed while incarcerated, as verified by the correctional facility. How Credit is Calculated
  • Community service is credited at the current minimum wage, unless the Court orders a different rate.
  • For individuals who performed qualifying work while incarcerated on or after July 1, 2023, the credit is based on the difference between the community service rate and the hourly wage received while incarcerated, multiplied by the number of hours worked.
  • Work performed while incarcerated before July 1, 2023, is not eligible for credit without a Court Order. Forms If you are requesting credit for qualifying work performed while incarcerated, you may need the following forms:
  • DC-212 — Request for Community Service Credit Complete the top of the form and mail it to the correctional facility. File DC-366 and DC-366A below — only if interest has accrued on fines and costs during your incarceration.

  • Form DC-366A (PDF) — Request for Waiver of Interest on Fines and Costs If interest has accrued on your fines and costs while you were incarcerated, complete the DC-366 and DC-366A and mail both forms to each correctional facility where you performed qualifying work. The correctional facility will:
  • Complete the certification;
  • Verify your period of incarceration and qualifying work, as required; and
  • Mail the completed forms directly to the Loudoun County Circuit Court Clerk's Office. Please note:
  • Participation in the program is subject to Virginia law and Court approval.
  • Correctional facilities are responsible for verifying qualifying work performed while incarcerated.
  • Credits are applied toward eligible Court-Ordered fines and costs. Important The Clerk's Office cannot accept DC-366 or DC-366A forms directly from defendants or any person other than the correctional facility. Forms must be mailed to the Clerk's Office by the correctional facility.
